O Ministério da Agricultura, Pecuária e Abastecimento (MAPA) é órgão responsável pela regulamentação, inspeção e fiscalização dos vinhos e bebidas em geral.
Os vinhos e bebidas devem ser registradas junto ao MAPA previamente à sua comercialização.
Segundo o Ministério da Agricultura, Pecuária e Abastecimento, para uma bebida ser considerada vinho, a bebida tem que ser obtida através da fermentação do mosto simples de uva sã, fresca e madura.
O que é preciso fazer para registrar vinho no MAPA?
É preciso que sua empresa possua o Registro de Estabelecimento de bebidas regularizado junto ao Ministério da Agricultura, Pecuária e Abastecimento.
No caso do setor vitivinícola, e para a produção de vinho, deve ser feito a petição de um Registro de Produtor ou Fabricante. O Registro de Estabelecimento é válido em todo território nacional e apenas precisa ser renovado a cada dez anos.
Para esta documentação, estão asseguradas as empresas que produzem bebida a partir de produtos primários, semi-industrializados ou industrializados de origem pecuária.
Como Registrar Vinho no MAPA?
Depois que você obteve o Registro de Estabelecimento para Fabricante e Produtor ou Importador, sua empresa estará apta para começar a registrar vinho no MAPA.
Para isso, é necessário elaborar uma solicitação contendo algumas informações sobre o vinho. Nela deverão conter dados como os percentuais dos ingredientes, a denominação e os aditivos.
É importante ter em mente que para estruturar o registro de vinho no MAPA, deve-se estabelecer previamente em quais categorias o produto se aplica.
As cervejas e cachaças devem ser registradas junto ao MAPA previamente à sua comercialização.
Inicialmente é necessário que a sua cervejaria esteja registrada no Ministério da Agricultura (MAPA), através do Registro de Estabelecimento, com a atividade de importadores, fabricantes, exportadores.
Existem diferentes tipos de registros de empresas no MAPA, sendo que para a produção de cerveja será necessário entrar com o pedido de Licença de Produtor / Fabricante. Este registro destina-se para estabelecimentos que transformam matéria-prima, semi-industrializados ou industrializados de origem agropecuária em bebidas.
O Registro de Produto é obtido após, sendo um documento emitido pelo MAPA, legalizando o mesmo para comercialização. Todo produto ou mercadoria que dependem de regularização junto ao Ministério da Agricultura precisa obter esse registro para antes de comercializar.
Antes de iniciar o processo para registrar cachaça no MAPA, é necessário que a empresa possua o do Registro de Estabelecimento.
Este registro destina-se para estabelecimentos que transformam matéria-prima, semi-industrializados ou industrializados de origem agropecuária em bebidas. Não importa se a empresa não destila o produto, mas se ela compra o destilado e depois padroniza colocando açúcar, corrigindo o teor alcoólico e depois realiza o envase ele se torna Fabricante e precisa estar regularizada no MAPA.
O Registro de Produto é obtido após, sendo um documento emitido pelo MAPA, legalizando o mesmo para comercialização.
A Licença de Cervejaria é válida em todo território nacional e deve ser renovada a cada dez anos.

How to Register Wines with MAPA?

The Ministry of Agriculture, Livestock, and Food Supply (MAPA) is responsible for the regulation, inspection, and oversight of wines and beverages in general.
Wines and Beverages in General:
Wines and beverages must be registered with MAPA prior to commercialization.
According to the Ministry of Agriculture, Livestock, and Food Supply, for a beverage to be considered wine, it must be obtained through the fermentation of fresh, healthy, and ripe grape must.
What is required to register wine with MAPA?
Your company must have its Establishment Registration for Beverages regularized with the Ministry of Agriculture, Livestock, and Food Supply.
For the wine industry, and for wine production, a Producer or Manufacturer Registration petition must be submitted. This Establishment Registration is valid nationwide and only needs to be renewed every ten years.
This documentation is required for companies that produce beverages from raw, semi-industrialized, or industrialized agricultural products.
How to Register Wine with MAPA?
Once you have obtained the Establishment Registration for Manufacturer or Producer, or Importer, your company will be eligible to start registering wine with MAPA.
To do so, you need to submit a request containing information about the wine, including the percentages of ingredients, denomination, and additives.
It is important to note that before structuring the wine registration with MAPA, you must establish which categories the product applies to.

Beers and cachaça must be registered with MAPA prior to commercialization.
How to Register Your Brewery and Beer with MAPA

It doesn’t matter if the company doesn’t distill the product itself, but if it buys the distilled spirit, then standardizes it by adding sugar, adjusting alcohol content, and packaging it, it becomes a Manufacturer and must be regularized with MAPA.
The Product Registration is obtained afterward, and it is a document issued by MAPA, legalizing the product for commercialization.

Para falar sobre a importância desses documentos, vamos relembrar qual a função deles para a segurança do trabalho.
O PPP depende do LTCAT para ser elaborado corretamente. Os dois devem ser atualizados regularmente para garantir os direitos do trabalhador e para evitar punições às empresas.
Os dois documentos devem obrigatoriamente preenchidos por todas as empresas, inclusivo as microempresas e as empresas pequeno porte. No entanto, logicamente é preciso tomar especial cuidado em casos onde a empresa trabalha com agentes nocivos.
O LTCAT é de propriedade da empresa, e deve ser divulgado no eSocial, pois é uma grande fonte de informações sobre segurança do trabalho. Já o PPP deve ser entregue para o trabalhador, e a sua divulgação a terceiros é crime.
O LTCAT tem prazo de validade indeterminado, mas deve ser renovado ao menos uma vez por ano ou toda vez que a empresa sofrer alterações no ambiente de trabalho. Por consequência, sempre que o LTCAT for alterado é preciso registrar a alteração também no PPP.
É preciso, também, disponibilizar o LTCAT no eSocial. Caso qualquer uma dessas exigências não seja cumprida, a empresa está sujeita a multas.
Os valores das penalidades foram aumentados em janeiro deste ano em 4,48%. Com o aumento, o valor da multa por não entrega do PPP pode variar de R$ 2.519,31 a R$ 251.929,36 de acordo com a gravidade da infração. A não atualização da LTCAT implica em multa de R$25.192,89.

What is the importance of LTCAT and PPP?
To understand the importance of these documents, let’s recall their role in occupational safety.
LTCAT: The Technical Report on Working Conditions. It serves to confirm that the worker is exposed to harmful agents to their health or physical integrity, whether they are physical, biological, or chemical. It is the basic source of information for the PPP.
PPP: The Social Security Professional Profile is a document aimed at providing information about the work environment of the employee, especially for requesting special retirement.
The PPP relies on the LTCAT to be properly developed. Both documents must be updated regularly to ensure workers’ rights and to avoid penalties for the company.
Who is required to submit LTCAT and PPP?
Both documents must be completed by all companies, including micro and small businesses. However, special attention should be given in cases where the company works with harmful agents.
The LTCAT is owned by the company and must be disclosed in eSocial, as it is a significant source of occupational safety information. The PPP, however, must be delivered to the worker, and its disclosure to third parties is illegal.
What happens if the LTCAT and PPP are not updated?
The LTCAT has an indefinite validity period but must be renewed at least once a year or whenever there are changes to the work environment. Consequently, whenever the LTCAT is altered, the changes must also be recorded in the PPP.
Additionally, the LTCAT must be made available in eSocial. Failure to comply with any of these requirements exposes the company to fines.
